Release Waiver of Liability and Indemnity Agreement

I understand and acknowledge that participation in martial arts activities—including but not limited to fencing, Gumdo, archery, Taekwondo, Jiu-Jitsu, wrestling, Judo, MMA, boxing, strength and conditioning, yoga, and related disciplines—involves inherent risks, involves inherent risks, including physical contact and the possibility of serious injury or death, including but not limited to the following: bruises, sprains, fractures, concussions, lacerations, dislocations, permanent disability, paralysis, amputation, and other serious bodily injuries.

This agreement applies to all classes, training sessions, events, workshops, and related activities conducted by Peak Performance Martial Arts LLC (doing business as “Peak Martial Arts”), whether on-site or off-site.

I understand that participation includes the use of training equipment and facilities, and I accept all risks associated with their use.

I understand that all reasonable precautions are taken to reduce the risk of injury; however, injuries may still occur. 

In consideration of being allowed to participate, I hereby release, waive, and discharge Peak Performance Martial Arts LLC, along with its owners, officers, employees, agents, and representatives, from any and all claims, liabilities, or causes of action arising out of or in any way related to my participation in these activities, including claims for personal injury, property damage, or loss, to the fullest extent permitted by law, including those arising from ordinary negligence.

I agree to indemnify and hold harmless Peak Performance Martial Arts LLC from any claims, damages, or expenses (including attorney’s fees) arising from my participation or, if applicable, the participation of a minor for whom I am legally responsible.

With full knowledge and understanding of these risks, I voluntarily choose to participate. I certify that I am physically able to participate in these activities and have no medical condition that would prevent safe participation, or I have consulted a physician prior to participation.

I grant permission to Peak Performance Martial Arts LLC to photograph and record me (or my minor child) and to use such images or recordings for promotional, advertising, or educational purposes, without compensation and with or without my name.

I agree to abide by all policies of Peak Performance Martial Arts LLC, including those provided at registration and any future updates.

This agreement shall be binding upon me, my heirs, assigns, and legal representatives. If any portion of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This agreement shall be governed by the laws of the State of Arizona.

If the participant is under the age of 18, the following must be completed by a parent or legal guardian:

I certify that I am the parent or legal guardian of the minor participant listed above.

I consent to their participation in all activities offered by Peak Performance Martial Arts LLC.

I acknowledge and accept all risks on behalf of the minor and agree to the terms of this agreement, including the release of liability and indemnification provisions.

I authorize Peak Performance Martial Arts LLC to obtain emergency medical treatment for the minor if necessary.

I agree to be responsible for any medical expenses incurred on behalf of the minor.

This agreement constitutes the entire understanding between the parties regarding liability and supersedes any prior discussions or representations.
